By scheduling, signing up for, or using our services, you acknowledge that you have read, understood, and agree to these Terms, which form a binding agreement. 1. Service Description
We provide professional pet waste removal for residential and commercial properties in Oklahoma. Our services include scooping, bagging, and disposing of pet waste from designated areas like front yards, backyards, or pet runs.
- Frequencies: One-time, weekly, bi-weekly, or custom schedules as specified in your service agreement.
- Limitations: We clean only visible waste. Hidden waste (e.g., in tall grass, leaves, or snow) or inaccessible areas (e.g., locked gates, unsafe conditions) may prevent service. Extreme weather (e.g., heavy rain, snow) may require rescheduling, with notice provided via email or phone.
2. Client Responsibilities
To ensure safe and efficient service, you agree to:
- Provide accurate details (e.g., number of dogs, yard size) during signup and update us promptly on changes.
- Ensure clear access to the service area (e.g., unlock gates, provide access codes).
- Secure pets indoors or in a safe area during service, especially if aggressive.
- Notify us of hazards (e.g., sharp objects, holes, chemicals) at least 24 hours before service.
- Maintain yards (e.g., mow grass, clear debris) to ensure waste visibility.
- Provide a trash receptacle for waste disposal or opt for our off-site disposal service (additional fees may apply, as specified in your service agreement).
Failure to meet these responsibilities may result in skipped service or reasonable additional fees, as outlined in your service agreement.
3. Access and Safety
- Locked Gates: If access is denied (e.g., locked gate), a $25 trip fee may apply unless you provide access within 15 minutes of our attempted contact. We will attempt to contact you via phone or email before leaving.
- Aggressive Pets: Unsecured or aggressive pets may lead to skipped service, charged at the standard rate. Repeated issues (three or more occurrences) may result in service cancellation with written notice. We are not liable for pet-related injuries or escapes unless caused by our gross negligence.
- Safety: Our team will not enter homes or risk unsafe conditions. We prioritize the safety of our team and your property.
4. Weather and Holidays
- Weather: Services may be rescheduled or skipped due to severe weather (e.g., rain, snow, thunderstorms) for safety. We will notify you via email or phone and reschedule within 7 days at no extra cost. No refunds are issued for weather-related skips; the next visit will address accumulated waste.
- Holidays: No service on Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas, or New Year’s Day. We will notify you and reschedule within 7 days at no extra cost.
5. Payments
- Pricing: Fees are tiered by number of dogs and visit frequency, as detailed in your written service quote (e.g., $15-$25 per visit for 1-2 dogs, weekly; initial cleanings may incur a one-time surcharge of up to $50 for accumulation, as quoted).
- Methods: Payments are processed via PayPal invoicing. A valid payment method is required before service starts.
- Billing: Monthly invoices are due within 7 days of receipt.
- Late Payments: Overdue payments incur a late fee of 10% of the invoice amount (capped at $25), payable when service resumes. Accounts unpaid for 30 days may face suspension or collection actions, with reasonable collection costs borne by the client.
6. Cancellations and Refunds
- Cancellation: Notify us at least 24 hours in advance via email (sales@simplepetwasteremoval.com) or phone ((405) 481-4278). Late cancellations incur a $25 fee, waived if rescheduled within 7 days.
- Rescheduling: Reschedule with 24 hours’ notice at no cost, subject to availability.
- Refunds: No refunds for completed services. For client-caused misses (e.g., locked gates, unsecured pets), a partial refund (50% of the service fee) may be issued if you notify us within 24 hours. Pre-paid services canceled early may forfeit promotional discounts, as specified in your service agreement.
7. Satisfaction Guarantee
We aim for your complete satisfaction. If you are dissatisfied with a service, contact us within 24 hours at sales@simplepetwasteremoval.com or (405) 481-4278. We will review the issue within 48 hours and, if the service was not performed to our standard (e.g., visible waste left behind), provide a free re-clean within 7 days or a credit toward your next service, at your choice.
8. Termination
- By You: Terminate with 7 days’ written notice via email or mail. You must pay all outstanding balances.
- By Us: We may terminate for non-payment, repeated access issues (three or more occurrences), or unsafe conditions, with 7 days’ written notice unless immediate termination is required for safety.
- Effect: All outstanding fees must be paid upon termination.
9. Liability and Insurance
We carry liability insurance for accidental damage caused by our team. We are not liable for:
- Pre-existing damage or pet behavior (e.g., escapes, bites).
- Minor property wear from normal service (e.g., lawn marks from equipment).
- Injuries or damages unless caused by our gross negligence or willful misconduct.
Report claims within 48 hours to sales@simplepetwasteremoval.com. You agree to hold us harmless from claims arising from your negligence (e.g., failure to secure pets or disclose hazards).
10. Privacy Policy
We collect your name, address, phone, email, payment information, and pet details to provide services and process payments. Data is stored securely using industry-standard encryption and shared only with payment processors or as required by law. 11. Intellectual Property/Photos
We own all service-related content (e.g., website materials, service protocols). 12. Force Majeure
We are not liable for service delays or cancellations due to events beyond our control (e.g., natural disasters, government restrictions, severe weather). We will notify you via email or phone and reschedule promptly at no extra cost.
13. Governing Law
These Terms are governed by Oklahoma law. Disputes will be resolved in Oklahoma County, Oklahoma courts, and you consent to their jurisdiction and venue.
